1. Before you use the IBTC card please read these Terms and Conditions thoroughly. If you keep or use the IBTC card, you will be deemed to have unconditionally agreed to these Terms and Conditions and they will govern the use of the IBTC card. If you do not wish to accept these Terms and Conditions, please cut the IBTC Silver card into half and return the pieces to us as soon as possible.
Definition
In these Terms and Conditions, the following words shall have the respective meanings set out hereunder, unless the context otherwise requires:
- IBTC cards” shall mean IBTC cards issued by the International Business Travellers’ Club.
- Member: One who has applied for the IBTC membership and whose application has been accepted and is a holder of the IBTC membership and also includes the person to whom an IBTC card is issued at the instance of the member.
- Membership: Means the various membership schemes offered by IBTC i.e. IBTC Blue, IBTC Silver, IBTC Tourister card and any other.
- Basic Card member: means the individual in whose name the membership is maintained.
- Charge: means any usage of the IBTC membership
- Maximum usage Limit: means the maximum amount which is permitted by us to the member. This applies at present only to the IBTC Tourister card and the IBTC Silver card.
- Establishment: means any corporation, hotel, resort, car rentals company, travel agent, restaurant, firm, company, business organization, Public sector undertaking, Government body, Semi-Government body or person that accepts or is willing to accept the IBTC card and offer the IBTC benefits.
- P. I. N.: means the Personal Identification Number given by us or chosen by you for use of membership.
- Add-on card member: means an individual other than the basic member to whom a membership has been issued at the request of the basic card member and the individual whose usage of the membership is linked to the Basic card member’s membership.
- Terms & Conditions: means the terms and conditions set out herein and by which the use of the membership shall be governed and shall include all modification and supplementals thereto from time to time “We” “Our” “Us” “IBTC” means "International Business Travellers’ Club”. “You” and “Your” means the Basic card member or where appropriate Add-on card-member
- CSD: shall mean the Card Services Directory and associated material enclosed with the same which lists the manner in which the IBTC card is to be used.
- Kit: The IBTC kit shall consist of the list of Establishments along-with check-in stickers, and an identity card, and any other material which shall be sent by us to you.
- Bookings: shall mean a reservation made at any of the Establishment by IBTC for the member.
The headings in these Terms and Conditions are for convenience only and shall not affect the interpretation of the provision in these Terms and Conditions. Unless the context otherwise requires or permits, reference to the singular number shall includes references to the plural number and vice-versa and references to natural persons shall include bodies or corporates.
1. Use of IBTC Membership
(a) Statutory Compliance
The IBTC membership issued to you can be used in India and
overseas. You agree and undertake that the IBTC membership
issued to you shall be utilized strictly in compliance with
the relevant exchange control regulations, issued and as
amended by the Government of your nationality.
You agree to comply and if you are the Basic card member,
to procure the compliance by all Add-on card members of any
exchange control regulations and other applicable laws from
time to time in force in your country.
2. Manner of use
- Sign the identity card given or issued to you in ink as
soon as you receive it and before you use it.
- Keep the identity card and any PIN secret and both
separate from each other.
- Only use your membership within the validity dates or
till the maximum usage is utilized by you, whichever is
earlier.
- Do not give your membership details to others or allow
them to use it for charges, identification or any other
purpose. If you do so, you will be liable for the
transaction as well as the cancellation of your membership
as well as also for the loss occasioned thereby to IBTC. The
decision of IBTC as to the amount of loss suffered by it
shall be final and binding upon you. You irrevocably
authorize IBTC to take such steps as may be necessary for
recovering the loss from.
- Only you can use the membership.
- Any reservation made on phone/ Fax/ Internet/ Email by
you shall be conclusive without acceptance of the
transaction amount or debit to your credit card.
- Do not use your membership for any other person other
than yourself. If you are found to have used the IBTC
membership for an extra room or an extra Car your membership
is liable for cancellation. There shall be no refund of your
membership fees. The decision of IBTC regarding misuse by
you of the membership shall be final and binding on you.
3. Liability
If you are a Basic card member, you are liable for all
transactions on the Basic card and of any and all Add-on
membership issued at your request and you agree that all
Add-on memberships shall be used in a manner with these Terms
and Conditions.
Terms and Conditions
If you are a Add-on card member you agree to use the Add-on
card bearing your name and will be jointly and severally
liable with the Basic card member for all usage made in
connection with the Add-on card.
All communication sent or given to the Basic card member or
the Add-on card member shall be deemed to be sent or given to
both.
4. The Maximum usage Limit:
The maximum usage limit as far as the member is concerned
shall be informed to him at the time of issuing the card.
There is no maximum usuage limit at present for the Blue
card membership. However should we decide to put a limit then
we shall inform you accordingly. If you are about to exceed
your maximum usage limit, in the opinion of IBTC, no booking
shall be made by IBTC for you till your membership is
renewed.
If your membership is not renewed when called upon to prior
to the validity or prior to utilizing your maximum usage limit
your membership shall be cancelled and you shall have to apply
once again along-with payment of the applicable registration
fees. In no event you shall be entitled to a refund of your
membership fees.
The Silver card shall be valid for a period of 3 years from
the date of issue or a maximum usage of Rs.70, 000/- or USD
1500. The maximum usage limit may be increased by IBTC upon
payment of such higher fees as may be prescribed by IBTC.
The IBTC Tourister card shall be valid for a period of
one year from the date of issue or a maximum usage of Rs.30,
000/-. The IBTC Tourister card is valid in India and
Nepal.
4.1 Security Period
The security period is the period for which after receipt IBTC shall prescribe for non usage of your IBTC Membership card. The same shall be applicable even if the card has been received by the member. At present the security period is one month from the date of receipt of the application form. This security period of one month may be revised from time to time. The security period excludes the processing time which usually takes 1 – 2 weeks.
5. Obligations of the Member
The member is not entitled to transfer his or her
membership. The benefits of the membership cannot be
transferred to travelling companions. In so far as the Silver
Card member is concerned the benefits shall be available to
him only on single occupancy charges for the establishment
accommodation actually occupied by the member. However the
member shall be entitled to the benefits against the charges
for the establishment accommodation if all the persons
occupying such accommodation are IBTC Silver Card members.
5.1
If the IBTC Silver cardholder is found to have frauded the IBTC Company by the primary cardholder not being at the hotel and another staying in the property. The IBTC company shall be able to proceed legally through civil proceedings i.e. criminal charges or shall debit the cardholder for the rack rate of that particular stay and all previous stay or all other products and services utilized by the cardholder of the IBTC Silver card on the rack rate . The debit on the cardholder credit shall be debited for the full rack rate and the earlier amount of 50% debited to his credit card shall not be refunded. The IBTC company shall be at liberty to claim further damages. The cardholder shall have waived his rights and interest to the amount debited to his or her credit card until he has proven that no fraud was committed on the IBTC company.
6. Membership fees:
The membership fees are payable for use of the Basic card
and on each Add-on card or other cards at such rates as we
prescribe from time to time. Any fee redemption or waiver that
maybe offered by us from time to time. Any fee redemption or
waiver that maybe withdrawn or restricted by us at any time at
our discretion without any prior notice or intimation of any
nature whatsoever.
7. Bookings and Reservations
To avail of the benefits all bookings and reservations at
the establishments have to be made through the reservation
form which shall be sent to you. Any bookings or reservation
made directly with the hotel shall not be eligible for the
benefits.
Bookings and reservation are made subject to availability.
All payments have to be made in advance through cash or credit
card or demand draft. All applicable taxes shall be levied and
the same may vary from one establishment to another.
As far as the Blue card members are concerned the payments
may or may not be made in advance. Should the member need to
extend his or her stay he could extend his/her stay by doing
so after faxing another reservation form.
All establishments may not participate in the IBTC
programme therefore the hotels directly may not make any
representation regarding the IBTC offer. You shall be solely
responsible for any taxes that may be applicable and on all
charges incurred on the IBTC membership and if we are required
under law to collect and deposit the same with the appropriate
regulatory authority, the same may be debited from the
membership fees applicable on the Silver and Tourister
card.
10. Default
We may treat your account as being in default if you fail
to pay any amount when it is due, or if any statement made by
you to us in connection with your membership is false or
misleading or if you breach any other agreement you may have
with us or if a petition for your bankruptcy is issued. If
your membership is in default, we are entitled to require you
to pay us immediately all sums outstanding on your account an
we reserve the right to offset the balance from your
membership fees. You further agree that, if you default you
will pay us all expenses incurred or expended by us on your
behalf, including legal fees, in recovering or attempting to
recover any monies owing to us from you or on your
account.
11. Use of External Agencies
We have the sole discretion to appoint agents to collect
amounts payable to us, as we consider necessary. For this
purpose, information regarding your membership will be
supplied to the agents. However, we will not be responsible
for any consequences arising out of the agent’s acts of
commission or omission. All charges payable to such agents to
collect our dues will be to your cost and risk in addition to
all costs, charges and expenses incurred by us to recover the
outstanding dues/ amounts.
12. RENEWAL – REPLACEMENT CARDS.
The membership shall be valid until the validity period as
printed on the face of the membership identity card or till
the utilization of the maximum usage limit, whichever is
earlier. You are hereby requesting us to issue to you a
renewal or replacement membership identity card before the
current membership expires. If you are the Basic card member,
you are hereby requesting us to issue to any Add-on card
member renewal or replacement or Add-on cards expires. We will
bill the membership fees accordingly.
13. Exchange Control and Tax laws of your country
You must comply with any and all applicable exchange
control and tax laws and regulations affected by the use of
the membership, and you agree to indemnify us against any
consequences if you fail to comply with these laws and
regulations.
14. Card-member information and
Consent
You authorize us and our affiliates to make credit
investigations about you. We may ask consumer reporting,
reference schemes or banks for consumer reports of your
history and information schemes, banks or other creditors. We
may exchange any information we receive about you with our
affiliates, including any credit or other information we may
obtain from your application or consumer reports. We may
disclose information about you to (a) companies who are
affiliates of IBTC (b) to any other party whose name or logo
appears on the membership identity card (c) to our suppliers
(d) to organizations who accept the IBTC card in order to
administer and service your membership and manage the
membership benefits or other programmes such as insurance
etc., which may be implemented from time to time and which you
may enroll into. We may also be required to disclose and
accordingly furnish details of your membership at the request
of any Government or regulatory body/ or any other statutory
authority or officials of the country you reside in. From time
to time we may monitor telephone calls between you and us to
assure the quality of service.
We may use information you have provided to us on your
application and in surveys, information derived from how you
use our services, for marketing activities by us and our
affiliates. We may also use this information to develop
mailing lists with whom we work to develop offers you may
receive through the mail.
If you believe that any information we hold about you or
information we provided to a consumer reporting or reference
scheme is incorrect, please write to us at the address
mentioned above. Any information which we find to be
inaccurate will be corrected promptly.
15. Authorisation
Transaction may require prior payments from your end.
Should we receive payment we may authorize the credit at any
of the establishment. We reserve the right and sole discretion
to cancel the authorization given to the establishment at any
time without prior intimation or notice to you.
16. Lost, Stolen or Misused cards
You must notify us immediately if your IBTC Card is lost,
stolen, mutilated not received when due, or if you suspect
that the card is being used without your permission. In the
case of loss or theft you must file immediately an appropriate
First Information Report (FIR) with the Police station nearest
to the place of occurrence and file a detailed report with us
enclosing a copy of the report submitted by you to the Police
Authorization.
17. Your Address
You must notify us immediately of any change in your name
and/ or address or the names of any Add-on card members.
18. Billing Errors or Enquires problems with
Transaction
If you have a problem with any transaction,please write to us at once and we will
take reasonable steps to assist you by information as may be necessary in relation
to the transaction.We may charge a reasonable administrative fee for statement of
bills,The amount for each case received as a chargeback to be replied an amount of
Rs.500/- shall be charged as legal fees.if an establishment issues a credit slip in
respect of a transaction we will upon receipt of the credit slip credit the
membership fees.
Any claim or disputes against any establishment must be directly resolved by you.No
claim or dispute establishment shall enable you to any set off or counter claim
against us. We shall not be liable to you for quality price or services or any
defects in such services provided by the establishment or if an establishment
refuses to accept the IBTC card law to contrary,you are not entitled to without
payment of any due amount because of such a dispute.
19. Charges in Foreign currencies
Charges in a foreign currency shall be converted into
Indian Rupees or US Dollars.
20. Our Property
Although for your use the IBTC card is our property at all
times. This means you should return the card to us if we
should request the repossession, revocation or request for the
return of the card. Such return or request for return is not,
and shall not constitute any reflection on your character or
worthiness of your credentials and we shall not be liable for
any statement made by any person requesting the return of the
card.
21. Right of Set-off
In the event of your delaying or being unable to settle
your outstanding as provided in this agreement for any reason
whatsoever, you expressly and unconditionally authorize us to
set off and adjust any such outstanding against the membership
fees and thereby proportionately reduce the maximum usage
limit where applicable.
23. Changing these terms and conditions and
policies
We reserve the right to change these Terms and Conditions
and policies, features and benefits offered on the membership
at any time by giving you intimation thereof without
limitation in the respect of the charges of the present
benefits. By keeping or using the IBTC card you are deemed to
have agreed to such changes. If you do not accept any of the
terms and conditions you may cut into half the IBTC card and
return both halves to us. You will still be liable for all
other transactions and there shall be no refund of membership
fees.
25. Notices
We shall be entitled to send any notice to you by ordinary
post to your address last known to us. Any notice sent by us
shall be considered as received by you (5) days after the date
of posting.
26. No waiver of our rights
No forbearance, delay or failure on our part to exercise
any power or right by us. unless these Terms and Conditions
shall operate as a waiver of such power or right, nor shall
any single or partial exercise of such power or right preclude
any further exercise of that or any other power or right nor
shall it constitute the waiver thereof.
27. Assignment
We may assign any of our rights under these Terms and
Conditions at any time without your consent.
28. Governing Law
These terms and conditions are governed by laws in India.
All members submit themselves to the exclusive jurisdiction to
the courts of Mumbai in India only.
Any dispute, difference or claim arising between the
members and IBTC shall be referred to the Sole Arbitration of
Mr. Sanjay Jain or any person nominated by him. The Arbitrator
so appointed shall have summary powers.
You shall not object to the Arbitrator so appointed on the
ground that he is an employee or associated with IBTC. In the
event Mr. Sanjay Jain or the other person nominated by him
cannot act as Arbitrator for any reason whatsoever then there
shall be no Arbitration Agreement.
29. Cooling Off Period & Cancellation of Membership
The cardholder shall have a period of one month within which he can
cancel his membership. However at this time cancellation charged
shall apply 5% of the membership or Rs. 500/- whichever is higher.
There shall be no cancellation after the one month as the amount
paid is invested in various formats and the same is not connected
with regards to the member. After the one month the obligation of
IBTC is to ensure the member receives his IBTC benefits being a 50%
discount on hotels and the various other benefits added to the list
of benefits from time to time. However the security deposit shall
be returned. The amount for registration is non refundable and is
categorized as the same as membership fees. No correspondence shall
be entertained with regards to cancellation after the cooling
period is over.
30. Other Terms and Conditions
The use of the IBTC membership is also subject to other
Terms and Conditions governing the use of other facilities or
benefits, which may from time to time be made available.
